Booking Terms and Conditions


1. General Terms and Conditions.

This document outlines booking terms and conditions of a booking contract between any person purchasing products and/or services or itinerary arrangements from adventurenewzealand.com. The "client" as mentioned in these booking terms and conditions refers to any person purchasing or who has purchased any product or service or itinerary arrangement from adventurenewzealand.com Ltd also known as www.adventurenewzealand.com and subject to the following:

(a) adventurenewzealand.com Ltd undertake to offer bookings for products and services displayed at www.adventurenewzealand.com with due care to the best of our ability.  We will not be liable for any loss or damage or loss of enjoyment, which result from the act, default or omission of any person other than ourselves or any cause beyond our control.  This includes (but not limited to) any loss, damage or loss of enjoyment which arises directly or indirectly from the following:Acts of God, weather disruptions, dangers incidental to sea, fire, breakdown in vehicle, machinery or equipment, acts of Government or Authorities whether legitimate or not, Wars whether declared or not, hostilities, acts of terrorism, civil disturbances, strikes, lockouts, riots, deaths pilferage, epidemics, quarantines or medial customs or immigration or emigration regulations.

(b) All products displayed on www.adventurenewzealand.com are only confirmed once a confirmation voucher email has been sent any the enquirer's supplied email address. Most products and services displayed on adventurenewzealand.com are confirmed within 24 hours and no longer that 48 hours. However this timeframe is not guaranteed.

(c) Any supplied Visa or Master Card details that are supplied by a visitor to www.adventurenewzealand.com will not result in a charge being processed until all booking enquiries have had availability confirmed.

(d) If an enquiry has been made for multiple products, only products with confirmed availability will be charged to that users card. Bookings are only confirmed until a confirmation voucher has been received by the client.

(e) All products advertised on www.adventurenewzealand.com or referenced in any quotes from employees from www.adventurenewzealand.com are subject to availability and daily price changes. No quotes given either online over the phone or in writing are guaranteed and are subject to change without notice.

(f) Quotes given for Domestic or International flights are subject to pricing changes at the time of booking by an advneturenewzealand.com Ltd representative or consultant and are subject to the terms and conditions of the airline carrier. Booking fees may apply for all flight bookings on a per person basis.

(g) All booking services provided by www.adventurenewzealand.com are subject to the booking terms and conditions and cancellation policies of the individual suppliers of any product and/or service being booked by www.adventurenewzealand.com on behalf of the client.

 


2. Booking Contract

By purchasing any product or service advertised on www.adventurenewzealand.com or if you the client intend on using any travel itinerary service facilitated by adventurenewzealand.com or any of its employee's, your are entering into a booking contract subject to the following terms and conditions.

(a) adventurenewzealand.com Ltd accepts responsibility for the performance of this role and for the negligence of its employees. However, to the maximum extent permitted by law. adventurenewzealand.com Ltd disclaims all liability for any technical errors, corruption of any data, unauthorized access to your personal data, inaccuracies in information supplied by third parties, or failure by the Agent to complete bookings where that failure is due to circumstances beyond his or her control.

(b) Under no circumstances will adventurenewzealand.com Ltd be liable for direct, indirect, consequential or incidental damages including but not limited to lost profits or savings or damages for disappointment of Products or Services.

(c) It is the client's responsibility to choose a product, service, package products or itinerary that the client sees fit for their capabilities and limitations. The majority of package itineraries offered require clients to be in reasonably good health. If clients have any doubts about their suitability for a particular trip, they should contact their Doctor and advise an adventurenewzealand.com Ltd consultant about any concerns or physical conditions that may prevent you from utilizing any booked product or service.

(d) adventurenewzealand.com Ltd has the sole authority to vary or omit any of these terms.

(e) This contract, including all matters arising from it, are subject to New Zealand law and the exclusive jurisdiction of the New Zealand Courts.

(f) The facilities and services we offer are subject to the terms and conditions of your individual contract with each supplier or booked products or services. By entering into this booking contract you agree forthwith that any terms and conditions stated by the supplier of booked products or services will be applicable to booked products and services. This is to include any levies liable for cancellations and amendments by the supplier of any product or service.

(g) adventurenewzealand.com Ltd reserves the right to revoke or refuse any booking of any product purchased on www.adventurenewzealand.com or by any of it’s booking agents.

(h) If for any reason a booking cancellation is required, you the client will be notified in writing from an adventurenewzealand.com Ltd representative. Refunds will be made to the sum of any booked product or service that needs to be cancelled or amended. Products or services of and equal value may be offered as an alternative at no obligation to you the client to purchase.


 

3. Supply of Products and Services

When we make bookings on your behalf, we are acting as a booking agent for the suppliers products, service or packaged itinerary advertised on www.adventurenewzealand.com . We have no direct control over the products and services advertised and arranged by adventurenewzealand.com ltd. Every endeavor is made to check products and services prior to client bookings.

Please be aware of the following:

(a) The facilities and services we offer are subject to the terms and conditions of your individual contract with each supplier.

(b) adventurenewzealand.com ltd will not be liable for any loss or damage arising from the provision of these products or services.

(c) Where circumstances arise that a supplier of facilities or services is unable to provide a specific product or service then that supplier may be entitled under your contract to substitute that product or service with equivalent products or service.

(d) All products and services booked by adventurenewzealand.com Ltd are subject to availability and pricing changes of the supplier.

(e) Travel insurance – We will not be liable for any medical, baggage, cash, travel delays or disruption – adventurenewzealand.com Ltd strongly recommend's that you have comprehensive travel insurance before undertaking your travel arrangements to cover any cancellation fees or accidents that may occur prior to or while on holiday.

 



4. Loss of Travel Voucher

(a)Any travel voucher issued to you the client must be printed out and carried for presentation at any booked product or service by an www.adventurenewzealand.com consultant or employee or through www.advnturenewzealand.com

(b) If you the client, loses a Voucher, reissue will be made at the absolute discretion of adventurenewzealand.com Ltd. A reprocessing fee of $20 NZD will apply per Voucher replacement.

(c) No refund or reissue will be made in respect of the loss of a Voucher unless the loss is reported, prior to date of reservation for any booked Product or Service to which the Voucher relates, and at the discretion of adventurenewzealand.com Ltd

(d) If adventurenewzealand.com Ltd elects to make a refund or to reissue a Ticket which has been lost, then the Person seeking the refund or reissue must undertake, in such form as is prescribed by adventurenewzealand.com Ltd, to repay adventurenewzealand.com Ltd the value of any refund or reissue in the event that the lost Ticket is used by any Person or if a refund or reissue is made to another Person in respect of that Ticket.

 

5. Website Information

adventurenewzealand.com Ltd does not guarantee exact accuracy of information contained on it's website ( www.adventurenewzealand.com ). Information such as dates, times, accommodation, images, and pricing are due to change without notice and at the discretion of adventurenewzealand.com. The data and services shown are provided in good faith and 'as is'. We do not warrant the accuracy, completeness, or fitness for a particular purpose of any data or services provided and to the maximum extent permitted by any law disclaimer all implied warranties in connection with such data or services. In no event shall we be liable for any injury, loss, claim, damage or any incidental or consequential damages, including but not limited to lost profits or savings, arising out of or in any way connected with the use of any display within this site. If you notice any inaccuracies please do not hesitate to advise us.

 

6. Payments for Individual Products and Services  

(a) If you the client are booking outside of 30 days from the first date of travel or use of any product, service or itinerary booked with adventurenewzealand.com Ltd, any of its employees or from www.adventurenewzealnad.com and for an amount greater than $1000 New Zealand dollars, a 20% deposit is required to begin a booking confirmation procedure.

(b) If you the client are booking inside of 30 days from the first date of travel or use of any product, service or itinerary booked with adventurenewzealand.com Ltd, any of its employees or from www.adventurenewzealnad.com or are attempting to book a product less than $1000 New Zealand dollars, full payment will be required to begin a booking confirmation procedure.

(c)  Some products and links displayed on www.adventurenewzealand.com may redirect you to our affiliate booking agencies, payment for products and services may be debited from your chosen payment method by external travel product booking businesses and will be reflected on your bank statement. Any bookings made through affiliate booking agencies will be subject to the terms and conditions of that agency.

(d)  Due to the nature of electronic bookings and inaccuracy in data displayed prices on adventurenewzealand.com are not guaranteed and are subject to change. adventurenewzealand.com Ltd reserves the right to cancel booked products and or services as it sees fit. In such circumstance, you the client will be offered a full refund or alternative booking at the price of the originally booked item at no obligation to purchase by you the client.

(e)  All prices quoted are in New Zealand Dollars and are subject to exchange rates.

(f)  Quote will be payable in the New Zealand amount at time of payment.

(g)Prices quoted for products and services are not guaranteed by adventurenewzealand.com and are subject to change without notice with full payment for products required to confirm or retain confirmation for any product or service booked by adventurenewzealand.com Ltd. This in particular relates to but is not limited to bookings for Domestic and International Airfares.

 

7. Payments for Custom Built Itineraries and Package Itineraries

(a) A $100 NZD itinerary deposit is required for Custom Built Itineraries and Package Itineraries purchased on www.adventurenewzealand.com or booked by and advneturenwzealand.com employee. This $100 itinerary deposit is completely refunded upon the booking of any product to the value of your itinerary deposit via and adventurenewzealand.com employee or from www.adventurenewzealand.com

(b) Once itinerary suggestions have met your complete satisfaction and if you the client are booking outside of 30 days from the first date of travel or use of any product, service or itinerary booked with adventurenewzealand.com Ltd, any of its employees or from www.adventurenewzealnad.com and for an amount greater than $1000 New Zealand dollars, a 20% deposit is required to begin a booking confirmation procedure.

(c) If you the client are booking inside of 30 days from the first date of travel or use of any product, service or itinerary booked with adventurenewzealand.com Ltd, any of its employees or from www.adventurenewzealnad.com or are attempting to book a product less than $1000 New Zealand dollars, full payment will be required to begin a booking confirmation procedure.

(d) Bookings can be made direct with adventurenewzealand.com ltd via Credit Card or Telegraphic Transfer.

(e) Due to the nature of electronic bookings and reliance of pricing data provided to adventurenewzealand.com by external sources, prices displayed on adventurenewzealand.com are not guaranteed and are subject to change without notice. adventurenewzealand.com Ltd reserves the right to cancel booked products and or services as necessary. In such circumstance, you the client will be advised and offered a full refund of the cancelled product or service or an alternative booking at the price of the originally booked item with no obligation to purchase by you the client.

(f) Some products and links displayed on www.adventurenewzealand.com may redirect you to our affiliate booking agencies, payment for products and services may be debited from your chosen payment method by external travel product booking businesses and will be reflected on your bank statement.

(g) All prices quoted are in New Zealand Dollars and are subject to exchange rates.

(h) All Quotes will be payable in the New Zealand amount at time of issue, prices and availability is subject to change with out notice and not guaranteed under any circumstances.



8. Cancellations

If it becomes necessary to cancel any booked Product, Service or itinerary, you must notify adventurenewzealand.com immediately in writing. Cancellation will take effect upon receipt by one of our sales agents of your written notice.

If cancellation looks foreseeable, please contact one of our sales agents immediately to discuss potential solution options. adventurenewzealand.com Ltd recommend's that you take out travel insurance, including cancellation insurance to minimise any cost incurred by you the client!

Please Note: There are no refunds given for early returns of Rental Cars and Motorhomes.

(a)  Cancellation up to 60 days prior to date of any reservation will be subject to a $50.00 NZD administration and banking fee and subject to any costs levied by any Suppliers of the Product and or Services booked.

(b)  If cancellation occurs after 30 days prior to departure, a cancellation of $20.00 NZD per booked item to be cancelled will apply. adventurenewzealand.com will charge a minimum cancellation fee of $100.00 NZD to cover banking and administration costs. Cancellation will also be subject to any costs levied by any Suppliers of the Products and or Services booked.

(c)  Cancellation within 7 days of departure/commencement of itinerary or failure to use any Product or Service booked by adventurenewzealand.com Ltd or booked on www.adventurenewzealand.com will be liable to a service charge valued at 20% of total booking amount and to a minimum of $100.00 NZD. Cancellation will also be subject to any costs levied by any Suppliers of the Products and or Services booked.

(d)  No refund will be made for any unused products or services which are either not taken up by you the client by the date of reservation indicated on any travel voucher or booking made by adventurenewzealand.com Ltd or issued electronically by www.adventurenewzealand.com . 100 % of the booking amount will be retained by adventurenewzealand.com in such an instance and you the client will be liable for any costs levied by any Suppliers of the Products and or Services booked.

(e) Cancellations that is eligible by you the client must be applied for in writing to adventurenewzealand.com Ltd and will be received once any cancellation has been confirmed by the supplier of the product or service booked. Refund payments will generally be made on the 20th of the month following the cancellation. Payment dates may vary and adventurenewzealand.com will not guarantee that payment will be made by the 20th of the month under any circumstance.


8a. Cancellations Continued - Guided Adventure Tours

(a) - DEPOSIT PAYMENTS - Deposit payments received for our Guided Adventure Tours are non refundable and in most cases non-transferable. We strongly recommend that you take out travel insurance, including cancellation insurance. To cover the event of any event of illness or injury, theft, delay or other travel mishap causing cancellation of your trip.

(b) - CANCELLATION OF FULL BALANCE PAYMENT - In the event that it becomes necessary for me to cancel the trip, I understand that the balance of the trip cost will be refunded according to the following schedule:
• Prior to 60 days before the commencement of the trip: full refund of balance.
• Within 60 days before the commencement of the trip: 50% refund of balance.
• Within 30 days before the commencement of the trip: no refund.

• Manuka trips only: I acknowledge that due to the inflexible deposit policies of the Milford Track Guided Walk concessionaires, the Manuka trip has a different deposit regime if I cancel or change my trip less than 100 days prior to departure. If this happens, adventurenewzealand.com Ltd may need to pay up to US$750 in cancellation penalties. I acknowledge that adventurenewzealand.com Ltd will do their best to keep these penalties to a minimum, but ultimately these are my responsibility.


9. Alterations and Amendments

A Fee of $20.00 NZD per booking item, plus any additional costs incurred by Suppliers of products and services will be charged if a change to any confirmed booking is requested by you the client.

(a)  Alterations and Amendments made to booking will be bound to the original booking Terms and conditions outlaid in this booking agreement.



10. Limitation of liability

(a)  adventurenewzealand.com Ltd will not be held liable under any condition for any amount in excess of the amount of any booking made by any client of adventurenewzealand.com. who wishes to take legal action against adventurenewzealand.com Ltd.

(b)  adventurenewzealand.com Ltd will not be held liable under any condition for damage to Property from leakage, explosion, stains, soot, or the effects of climate or the elements.

(c)  adventurenewzealand.com Ltd will not be held liable under any condition for loss of life or injury caused to any persons using a product or service booked on www.adventurenewzealand.com or by and adventurenewzealand.com Ltd representative.

(d)  All Persons booking any product or service displayed by adventurenewzealand.com Ltd do so at their own risk. adventurenewzealand.com Ltd is not liable in relation to the use or provision of its website or any of the products and services booked using adventurenewzealand.com

(e)  This contract, including all matters arising from it, are subject to New Zealand law and the exclusive jurisdiction of the New Zealand Courts.



11. Tax

All prices price's displayed on www.adventurenewzealand.com are inclusive of the New Zealand Government Goods and Services Tax."
